The new enacted law in California: "SB 1386" requires any organization that manages the sensitive data of a California resident to publicly disclose security breaches. This means if you have taken customers credit cards, addresses or other data and you think you have an employee who has broken into that data for any reason or gone through the trash and/or kept credit card carbons or written down any personal information at all, then you must have a log of the breach and alert any California Resident. Even if you have a Oil Change Shop where a former employee on drugs stole some data from your computer and you only have two California Residents in your entire system who were out of town when they had work done in your shop, you must alert them and if not and the former employee charges that card then you are doubly liable if you know of any instance where said employee stole any data off your computer system or any other place. To minimize exposure to SB 1386, organizations must ensure data privacy throughout the enterprise even if it is a one shop business. If you have a shop in CA or a freeway in a state near CA you had better have a plan in place to cover you rear end. Aparently Arnold has not gotten through to the law makers there yet? SB 1386, passed recently in the state of California, is a legal statute mandating that businesses publicly disclose computer security breaches if confidential information of a California resident may have been compromised. We expect those wonderful folks in Boston, DC, NYC, etc. to also follow with similar legislation as well as the Socialist Republics of Oregon and Washington State. Whether an institution is based in California or not, if it does business with or stores the personal data of even one California resident, the implications of this state law can be profound. Contact your local attorney to come up with a legal precautionary plan so he can make some money without ever even looking at an oily rag. If you saying right now "I hate attorneys" you are preaching to the choir. If you say you hate politicians, they are usually attorneys anyway so don't waste your breath. That is all we need in the Industry isn't it.
